Fair Play Policy

1. Use of the platform

• 1.1 By registering on, browsing, downloading, using or accessing www.3plusgames.com and mobile applications (collectively, the “Platform”) for participating in various fantasy games that are accessible through the Platform (collectively referred to as “Games”) and any promotional which would also include any free-to-play games (referred to as “Games”), you agree that you have read, understood and have agreed to be bound by the terms and conditions and privacy policy available at 3plusgames website and mobile application, and the terms prescribed hereunder (“Terms”).
• 1.2 In these Terms, any use of the words "They", "You", “User”, “Their”, “Them” or similar expressions shall mean any user of this Platform whatsoever. Terms such as "we", "us”, "our", “3Plus Games” or similar expressions shall mean 3Plus Games Private Limited.
• 1.3 If at any time the User does not accept or agree to any Terms, on a continuing basis in relation to any of the Games offered on the Platform, they should not access the Platform.
• 1.4 We reserve the right to periodically review, update, change or replace any part of these Terms as it may consider appropriate at its sole and absolute discretion.
• 1.5 Changes to these Terms will be posted on the website of the Platform wherever appropriate. Users are advised to check this page regularly for any updates regarding the Terms and conditions that apply to their use of the Platform. By continuing to use the Platform after any updates, changes, replacements, or modifications to the Terms, Users are deemed to have given their valid consent to such revisions.
• 1.6 We may at Our sole discretion:
  • 1.6.1 restrict, suspend, or terminate any User's right to participate in the Games;
  • 1.6.2 change, suspend, or discontinue all or any part of the Games;
  • 1.6.3 establish general practices and limits concerning participation in the Games;
• 1.7 In the event any User breaches, or reasonably believes that such User has breached these Terms, or has illegally or improperly participated in the Games, may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate the User’s right to participate in all or any part of the Games and debar Users from participating in the Games and, and further, take legal steps as it deems necessary.

2. Eligibility

• 2.1 The Users may participate in Games only if they are 18 years of age or over as of the date of commencement of the particular Games you are registering to.
• 2.2 Additionally, any User who is “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. is not eligible to play the Games.
• 2.3 The Users may not participate in the Games provided if You are a resident of any state in India in which participating, organising or conducting of such Games is prohibited.
• 2.4 The Games provided on the Platform may be subject to additional conditions or rules applicable to a particular Game(s) in that respect or specific rules applicable to policy-eligibility-individuals, if any (“Rules”). The mentioned Rules are considered to be included in this document by reference. Users must agree to these Rules before playing any such Games on the Platform. To the extent that these Rules are inconsistent with the Terms, the Rules shall prevail.

3. Fair play violations

• 3.1 A fair play violation (“Fair Play Violation”) means any activity of a User that violates this Policy and includes:
  • 3.1.1 activity that uses unfair means to manipulate the outcome of a Game or on the Platform, irrespective of whether this is in favour of the user adopting such means;
  • 3.1.2 activity that is fraudulent, illegal, or unfair activity, as determined by 3Plus games in its sole discretion;
  • 3.1.3 use of unauthorized components, create or use cheats, exploits, bots, hacks, or any other third-party software designed to modify, intercept, decrypt, or mine the Platform in any manner;
  • 3.1.4 transmission of files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer or 3Plus games Platform.
  • 3.1.5 activity that involves collusion between two or more players to achieve a result during a Game or, thereby amounting to syndicate playing; and
  • 3.1.6 activity that falls under the Prohibited Conduct set out in Clause 4 below.
• 3.2 By registering on and using the Platform, Users agree that they will not indulge in any Fair Play Violation, by any means. Any User found guilty of a Fair Play Violation shall be subject to the consequences set out in Clause 5 below.

4. Prohibited content

• 4.1 The following conduct is expressly prohibited on the Platform:
  • 4.1.1 use of multiple accounts to play the same Game or, as may be applicable;
  • 4.1.2 use of multiple accounts or colluding with other Users to unfairly achieve a collective outcome while playing any Game or ;
  • 4.1.3 use or availing of any form of external assistance to play a Game on the Platform;
  • 4.1.4 use of unauthorized components, create or use cheats, exploits, bots, hacks, or any other third-party software designed to modify, intercept, decrypt, or mine the Platform in any manner;
  • 4.1.5 dissemination or uploading of spam, unlawful content, or any unauthorised communication to other players on the Platform, or employees of 3Plus games.
  • 4.1.6 use of the Platform as a means of money transfer between persons or separate accounts, or any conduct that may amount to money laundering or other unlawful activities under Indian law; and
  • 4.1.7 uploading any content to the Platform, or registering a user ID, which is racist, casteist, profane, vulgar, offensive, or unlawful in any manner;
  • 4.1.8 any action that imposes an unreasonably or disproportionately large load on our infrastructure.
• 4.2 Users must ensure that all KYC documentation required at the time of registration on the Platform is accurate and valid, and if a user submits any falsified, forged, or fraudulent documentation, their account will be terminated immediately, and appropriate legal action may be taken.
• 4.3 All communication must strictly relate to matters related to the Platform. If a user is found to be engaging in offensive or illegal communication with another individual on the Platform, their access to the Platform may be terminated, and they may be barred from further use. The following forms of communication are specifically prohibited:
  • 4.3.1 Language that is vulgar or abusive, remarks that are racist, and comments that are offensive towards religion or caste;
  • 4.3.2 solicitation in any form by any player via the chat, spamming and causing a nuisance of any sort;
  • 4.3.3 flooding of chat window with recurring messages, or any sort of persistent or constant unwanted communication;
  • 4.3.4 advertising or promotional activity, or attempt to promote products or services of third-parties;
  • 4.3.5 malicious or defamatory content about the Platform or any of its other Users; and
  • 4.3.6 revelation of personal details like email addresses, contact numbers, postal addresses, etc.

5. Consequences of fair play violations

• 5.1 Fair Play Violations are closely monitored in all Games available on the Platform. If a Fair Play Violation is detected, the User accounts involved may be immediately terminated, and any funds in the accounts may be frozen until the issue is resolved.
• 5.2 Users who engage in Fair Play Violation may face permanent prohibition from accessing the Platform. Their accounts may be blocked, and any funds in the accounts may be frozen, as per the terms outlined in this agreement. This policy applies to users who benefited from Fair Play Violation and those who assisted or conspired in the act.
• 5.3 In the event, We believe or suspect that You have been engaged in Fair Play Violation, We shall have the right to investigate and monitor your account and your gameplay for such period of time as in Our opinion may be needed to investigate such breach.
• 5.4 The balance funds of users found guilty of Fair Play Violations may be frozen for such period as deemed necessary by Us. The investigation will encompass all the Games played by the User in question, from the moment they registered on the Platform.
• 5.5 If we determine, upon investigation, that your account has engaged in Fair Play Violations, we may take the following actions, limited to the amount involved in such violations:
  • 5.5.1 forfeit the fund in Your 3Plus Games Account;
  • 5.5.2 repatriate the amount to the Generally Affected User or individuals who have been affected by the Fair Play Violation; and
  • 5.5.3 In the event of a Fair Play Violation, a fee may be charged, which can be up to Rs. 10,000 or three times the entry fee paid for the game in question (whichever is greater) per instance of such violation. By using the Platform, you acknowledge that the fee is not a penalty, but a reasonable and justifiable cost that covers the expenses incurred by 3Plus Games in terms of manpower, technology, and damage to reputation due to your violation of the Fair Play Policy. The Fair Play violation fee may be debited from the funds in Your 3Plus Games Account or in the event the balance in Your 3Plus Games Account is not sufficient to cover the fee, we may raise a claim for such fee against You in accordance with the applicable laws. It is possible that the platform may initiate additional legal proceedings against you for the same instance of Fair Play Violation, and any fees charged may be in addition to such proceedings.
• 5.6 In the event of a Fair Play Violation review that reveals financial losses to a Genuinely Affected User, any resulting losses and additional penalties that may be imposed at the discretion of 3Plus Games may be recovered from the frozen funds of the User in question. In cases where the frozen funds are insufficient to cover the amount due, 3Plus Games retains the right to seek legal remedies to recover the outstanding amount. The remaining balance will be released to the User in compliance with applicable laws.
• 5.7 3Plus games reserve the right to review any Game or of any User at any point in time, and if any Game is found to be in violation of this Policy, then strict penalty and actions will be taken as per this Terms. There is no time constraint for the identification and implementation of action regarding a Fair Play Violation on the Platform.

6. Redressal for genuinely affected users

• 6.1 For the purpose of this Terms, a “Genuinely Affected User” shall mean
  • 6.1.1 a User who is subject to a direct monetary impact during a Game on account of a Fair Play Violation by one or more of the other players in that Game.
  • 6.1.2 A User who did not violate Fair Play rules and experienced a financial loss because of the cancellation of a game caused by a technical issue or any other reason that can be solely attributed to the platform.
• 6.2 Users who are truly affected may be eligible for a refund of their entry fees for the impacted game after verification and confirmation by the 3Plus games team. The refunds will follow the guidelines outlined in the Platform's other policies, including those governing Game cancellation and refund.
• 6.3 Genuinely Affected Users must report a Fair Play Violation within 72 (seventy-two) hours of the occurrence, via email to [email protected] or via the help section provided on the Platform. The 3Plus Games internal team will examine the reported game and provide an investigation report within 72 hours. Valid cases will be handled in accordance with the Game cancellation and refund policy. Necessary measures will be taken accordingly.
